The
Florida Judicial System and sentencing guidelines
for drug possession convictions can be very severe,
including, but not limited to:

1st
degree misdemeanor possession: possession of less
than 20 grams of cannabis (marijuana), which may
include a county jail sentence of up to 1 year, and a
$1000 fine.

3rd degree felony possession: possession of over 20
grams of cannabis, possession of small amounts of
cocaine, heroin, ecstasy, and pharmaceuticals
without a prescription, which may include
incarceration in a state prison for up to five
years.

2nd
degree felony possession: possession with the intent
to sell or deliver controlled substances such as
cocaine, heroin, ecstasy and pharmaceuticals, which
may include a prison sentence of up to 15 years.

1st
degree felony possession: possession of over 10
grams of controlled substances (such as cocaine or
heroin, possession with intent to sell cocaine near
schools or other proscribed zones), which may
include a prison sentence of up to 30 years.
